Tribal Court Trial Hearing Submitted: 09/29/2008
LAC DU FLAMBEAU - The five members taken off the Lac du Flambeau Tribal election ballot will not be allowed back on the ballot.

Cameras were not allowed in the courtroom.

And the five candidates and their lawyer say they are not satisfied with the judges decision.

Lawyers representing the Lac du Flambeau Tribal Council and the five candidates kicked off the ballot, appeared in court today trying to get the candidates names back on the ballot.

Glenn Reynolds is the lawyer for the five candidates. He says the hearing was pre-determined.

Reynolds tells Newswatch 12, "The judge said I don't have to give you the opportunity to call witnesses, that's discretionary, and I don't have to give you a chance to brief your case, that's discretionary."

Betty Jack is one of the candidates taken of the ballot. She says she fears for future generations.

Jack says, "We can get out the materials on the decision made by Judge Solier and then by Judge Ackley this morning so that our voter can understand how their children's children are going to be affected, and they will vote accordingly."

The Tribal Administration was not present at the hearing and declined to comment on the court case.

William Beson is a candidate still on the ballot. He was at the hearing today and says it was unfair.

Beson says, "It was such a miscarriage of justice, the judge had predetermined what his decision was going to be, and it was obvious that he and the prosecuting attorney from the tribe had conspired to try and find out what the outcome was going to be."

The judge ruled the candidates will not be allowed on the ballot. However, the candidates will to appeal that decision.

Even though the five candidates will not be on the election ballot, they say they are endorsing new candidates who support their ideas for change.

Again we tried contacting the Tribal Council and they declined to comment.
