Concealed carry challenge for domestic violence offenderSubmitted: 09/03/2013
Story By Associated Press

COTTAGE GROVE - A man with a domestic violence conviction wants to be able to carry a concealed gun.

The state denied a permit for 68-year-old Robert Evans of Cottage Grove.

He's challenging that decision.

If he wins, it could clear the way for those with certain domestic violence convictions to legally carry hidden guns.

Citing a federal ban, Wisconsin's Department of Justice denied Evans a permit in 2012 because he was convicted in ten years earlier of domestic violence/disorderly conduct.

Evans appealed in court.

He claims the offense isn't a misdemeanor crime of violence under federal law.

He also says he didn't have a domestic relationship with the victim.

A Dane County judge upheld the Department of Justice's decision to deny a concealed carry permit.

Evans has now taken the case to the Court of Appeals.
