He had left a morphine pill within reach of his baby daughter, Peyton Lonkoski.
When police told Lonkoski his daughter died of a morphine overdose, he asked for a lawyer.
He was arrested and read his rights, but later agreed to talk more.
Lonkoski wants to have those statements thrown out, and the state supreme court has agreed to review the case.
The case examines what counts as interrogation and custody under the Miranda rights.
