- Wisconsin's gay marriage ban will likely stay in effect as a lawsuit challenging it moves forward.
U.S. District Judge Barbara Crabb asked the American Civil Liberties Union to reconsider its request to temporarily nullify Wisconsin's gay marriage ban.
Crabb says any injunction would be immediately challenged.
That could lead to a stay of any order issued.
She advised the American Civil Liberties Union to withdraw its motion for the injunction.
Crabb says the plaintiffs should instead consider pursuing a ``swift final
determination'' in federal court.
Seventeen states and the District of Columbia have laws supporting same gender marriage.
