MADISON - Part of the policy that says who can legally gather in the Wisconsin state Capitol was blocked Monday.

Governor Scott Walker's administration adopted the policy.

They did it after demonstrations in 2011 grew as large as 100-THOUSAND people.

In February The American Civil Liberties Union filed a lawsuit on behalf of one person.

The person regularly sings protest songs in the Capitol over the noon hour.

U.S. District Judge William Conley issued a preliminary injunction.

It bars the Walker administration from distinguishing the type of gathering for purposes of issuing a permit.

Conley also barred enforcing the permit requirement for gatherings expected to draw fewer than 20 people.

A Walker spokesperson had no immediate comment.
