MADISON - The state's highest court will review the case of a rural Weston couple who prayed for their dying daughter instead of seeking medical help.

In 2009, Dale and Leilani Newmann were both convicted of second degree recekless homicide in Marathon county.

Their 11 year old daughter Madeline had juvenile diabetes, but the Newmann's did not know that.

As Madeline became sicker, the Newmann's gathered friends for prayer.

Madeline died in March of 2008.

The Neumanns argued their actions were allowed by the prayer treatment privilege granted under the child abuse statute.

An appeals court in Wausau previously said since the case is unique in Wisconsin, it would be appropriate for the Supreme Court to hear it.

The Supreme Court accepted the case today.

The Neumanns were sentenced to six months in jail and 10 years of probation.

The jail terms were delayed pending their appeals.
